COPYRIGHT POLICY


1. Copyright Infringement Notification

If you believe in good faith your copyright-protected work was posted on OLED SPACE without authorization, you may submit a copyright infringement notification. (If you are a US copyright owner, please see below for “DMCA notice for US users”) Make sure that you consider whether fair use, fair dealing or a similar exception to copyright applies before you submit.

Any queries regarding copyright and Your Content (as defined in Terms & Conditions) should be directed in the first instance to OLED SPACE copyright agent at copyright@lgdisplay.com.

2. DMCA notice for US users

If you are a US copyright owner or an agent of a US copyright owner and believe that any user Content or other Content on OLED SPACE infringes upon your copyright, you may submit a notification pursuant to Title 17, U.S.C., Section 512(c)(3) of the Digital Millennium Copyright Act of 1998 (“DMCA”) by providing our designated copyright agent (“DMCA Designated Agent”) with the following information in writing :

  -  A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  -  Identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the website, a representative list of such works.

  -  Identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material.

  -  Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address).

  -  A statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

  -  A statement that the information in the written notice is accurate.

  -  A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective. Upon receipt of a DMCA notice of claimed infringement, OLED SPACE will respond expeditiously to remove, or disable access to, the Content that is claimed to be infringing or to be the subject of the infringing activity. 

The DMCA notice should only be submitted by the copyright owner or an agent authorized to act on the copyright owner’s behalf. If you choose to request a removal of content by submitting a DMCA notice, please remember that you are initiating a legal process. Also, knowingly making false claims or misusing this process may result in the suspension of Your Account, and you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA. 

 

Under the DMCA, a counter notification is a legal means to state your objection if LGD removes or disables access to Your Content or sends you a DMCA warning via OLED SPACE’s private messaging system in response to a DMCA notice of Your Content. If you are a user who provided the allegedly infringing copyrighted Content, and believe that material you posted on OLED SPACE was removed or access to it was disabled by mistake or misidentification or that your use of the Content constitutes “fair use” and does not infringe the copyright holder’s rights, you may submit a counter notification containing the following information to our DMCA Designated Agent (contact information provided above):

  1. Your physical or electronic signature;

  2. Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled;

  3. A statement, under penalty of perjury, that you have good faith that the Content was removed or disabled as a result of mistake or misidentification of the Content; and

  4. Your name, mailing address, and telephone number, a statement that you consent to the jurisdiction of the State of California and the federal or state courts located in the State of California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement. 

If a counter notification is received by our DMCA Designated Agent, we will promptly send a copy of the counter-notice to the copyright owner and inform that the Content removed or disabled may be replaced. Unless the copyright owner files an action seeking a court order against the user who provided the Content and provides notice of such action to our DMCA Designated Agent, that Content may be replaced, or access restored, within 10 to 14 business days after receipt of the counter notice.

If you are unclear as to whether your situation falls into one of these areas, you may want to contact the copyright owner directly. Alternatively, you may want to speak with an attorney or a legal advisor regarding your specific situation, as LGD is not in the position to act in this capacity for you.

TERMS & CONDITIONS


This OLED SPACE Terms & Conditions (these “Terms”) applies to your access to and use of the websites, mobile apps, widgets, and other online products and services (collectively, the “OLED SPACE”) provided by LG Display Co., Ltd., a company duly incorporated under the laws of the Republic of Korea, having its principal place of business at LG Twin Towers (East), 128 Yeoui-daero, Yeouido-dong, Youngdungpo-gu, Seoul, 07336, Korea (“LGD,” “our,” “we” or “us”).


Remember that OLED SPACE is provided for its members to communicate about OLED freely, but we still need some basic rules. By accessing or using OLED SPACE, you agree and accept to be bound by these Terms. Please also take a look at OLED SPACE’s Privacy Policy and Copyright Policy as it explains how we collect, use, and share information about you when you access or use OLED SPACE. If you do not agree with or accept, without limitation or qualification, these Terms as well as our Privacy Policy and Copyright Policy, please do not  access or use OLED SPACE.


1. Your Access to OLED SPACE


Children under the age of 13 are not allowed to create an account or otherwise use OLED SPACE. Additionally, if you reside in the European Economic Area, you must be over the age required by the laws of your country to create an account or otherwise use OLED SPACE, or we need to have received verifiable consent from your parent or legal guardian.

In addition, certain features or portions of OLED SPACE require you to be older than 13 years of age, so please read all notices and any additional terms carefully when you access OLED SPACE.

If you are accepting these Terms on behalf of another legal entity, including a business or a government, you represent that you have full legal authority to bind such entity to these Terms.


2. Your Use of OLED SPACE


OLED SPACE may contain information, text, links, graphics, photos, videos, or other materials (“Content”), including Content created with or submitted to OLED SPACE by you (“Your Content”). OLED SPACE site and Content posted on OLED SPACE site are protected by the copyright laws and other intellectual property laws of the United States, the United Kingdom (and other applicable countries), and are protected globally by applicable international copyright treaties. 


LGD grants you a personal, non-transferable, non-exclusive, revocable, limited license to use and access OLED SPACE solely as permitted by these Terms. We reserve all rights not expressly granted to you by these Terms.

Except as permitted through the services or as otherwise permitted by us in writing, your license does not include the right to:


• license, sell, transfer, assign, distribute, host, or otherwise commercially exploit OLED SPACE or Content;

• modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of OLED SPACE or Content; or

• access OLED SPACE or Content in order to build a similar or competitive website, product, or service.


We reserve the right to modify, suspend, or discontinue the services (in whole or in part), in our sole discretion, at any time, with or without notice to you. Any future release, update, or other addition to functionality of OLED SPACE will be subject to these Terms, which may be updated from time to time. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of OLED SPACE or any part thereof.


You are expressly forbidden from accessing the Content or OLED SPACE, including by initiating calls to any OLED SPACE-related API, through any user interface, script, macro, bot, code or other mechanism not developed or provided by us, except within the parameters set forth in our robots.txt file.


3. Your Account and Account Security


To use certain features of OLED SPACE, you may be required to create an account (“Your Account”) and provide us with a nickname, e-mail address, and certain other information about yourself as set forth in the Privacy Policy. You agree that all information you provide to register with OLED SPACE or otherwise, including, but not limited to, through the use of any interactive features, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.


You are solely responsible for the information associated with Your Account and all activity on, through or in connection with Your Account. You must maintain the security of Your Account and promptly notify us if you discover or suspect that Your Account may be compromised. We recommend that you use a strong password that is used only with OLED SPACE.


You will not license, sell, or transfer Your Account without our prior written approval.

We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time if, as determined in our discretion, you have violated any provision of these Terms.


4. Your Content


We take no responsibility for and we neither expressly nor implicitly endorse any of Your Content. By submitting Your Content to OLED SPACE, 


• You understand and agree that, whether or not Content is published, OLED SPACE does not guarantee any confidentiality with respect to Your Content. 

• You retain all of your ownership rights in your Content, but you are required to grant limited license rights to OLED SPACE and other users of OLED SPACE. These are described in Section 5 below. 

• You understand and agree that you are solely responsible for Your Content and the consequences of posting or publishing it. OLED SPACE does not endorse Your Content or any opinion, recommendation, or advice expressed therein, and OLED SPACE expressly disclaims any and all liability in connection with Your Content.

• You represent and warrant that you have (and will continue to have during your use of OLED SPACE) all necessary licenses, rights, consents, and permissions which are required to enable OLED SPACE to use your Content for the purposes of the provision of the service by OLED SPACE, and otherwise to use Your Content in the manner contemplated by OLED SPACE and these Terms. 

• You agree that your conduct on the site will comply with (and you agree that the content of all of your Content shall comply with) these Terms herein, which may be updated from time to time.

• You agree that you will not post or upload any Content which contains material which it is unlawful for you to possess in the country in which you are resident, or which it would be unlawful for OLED SPACE to use or possess in connection with the provision of OLED SPACE.

• You agree that Content you submit to OLED SPACE will not contain any third party copyright material, or material that is subject to other third party proprietary rights (including rights of privacy or rights of publicity), unless you have a formal license or permission from the rightful owner, or are otherwise legally entitled, to post the material in question and to grant OLED SPACE the license referred to in Section 5 below.


You further understand and acknowledge that in using OLED SPACE, you may be exposed to Content that is factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against OLED SPACE with respect to any such Content.


5. License From You


When you upload or post Content on OLED SPACE, you grant LGD a worldwide, non-exclusive, royalty-free, transferable license (with right to sub-license) to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the provision of OLED SPACE and LGD's business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. The foregoing license includes the right for us to make Your Content available for syndication, broadcast, distribution, or publication by other companies, organizations, or individuals who partner with OLED SPACE. You also agree that we may remove metadata associated with Your Content, and, to the extent allowed under applicable laws, you irrevocably waive any claims and assertions of moral rights or attribution with respect to Your Content.


Any ideas, suggestions, and feedback about OLED SPACE or our services that you provide to us are entirely voluntary, and you agree that OLED SPACE may use such ideas, suggestions, and feedback without compensation or obligation to you.


Although we have no obligation to screen, edit, or monitor Your Content, we may, in our sole discretion, delete or remove Your Content at any time and for any reason, including for a violation of these Terms or if you otherwise create liability for us.


6. Other User’s Content on OLED SPACE


With the exception of Content submitted to OLED SPACE by you, all other Content on OLED SPACE is either owned by or licensed to LGD, and is subject to copyright, trade mark rights, and other intellectual property rights of LGD or LGD's licensors. Any third party trade or service marks present on Content not uploaded or posted by you are trade or service marks of their respective owners. Such Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of LGD or, where applicable, LGD's licensors. LGD and its licensors reserve all rights not expressly granted in and to their Content.


7. Copyright Policy


OLED SPACE operates a clear copyright policy in relation to any Content that is alleged to infringe the copyright of a third party. Details of that policy can be found Here.


8. Things You Cannot Do


When accessing or using OLED SPACE, you must respect others and their rights, including by following these Terms, so that we all may continue to use and enjoy OLED SPACE. We support the responsible reporting of security vulnerabilities. To report a security issue, please send an email to privacy@lgdisplay.com.


LGD hereby grants you permission to access and use OLED SPACE, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:


• You agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of OLED SPACE or features that (i) prevent or restrict use or copying of Content or (ii) enforce limitations on use of OLED SPACE or the content accessible via OLED SPACE;

• You agree not to use OLED SPACE or the services (including the comments and email features in OLED SPACE) for the solicitation of business in the course of trade or in connection with a commercial enterprise;

• You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of LGD or the respective licensors of the Content; 

• In any way violate applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries);

• You shall not use OLED SPACE to violate applicable law or infringe any person or entity’s intellectual property or any other proprietary rights;

• You shall not upload, transmit, or distribute to or through OLED SPACE any computer viruses, worms, or other software intended to interfere with the intended operation of a computer system or data;

• You shall not harvest, collect, gather or assemble information or data regarding OLED SPACE or users of OLED SPACE, except as permitted in these Terms or in a separate written agreement with LGD;

• You shall not use OLED SPACE in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying OLED SPACE or that could damage, disable, overburden, or impair the functioning of the services in any manner;

• Access, query, or search OLED SPACE with any automated system, other than through our published interfaces and pursuant to their applicable terms. However, we conditionally grant permission to crawl OLED SPACE for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials subject to the parameters set forth in our robots.txt file;

• You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of LGD or the respective licensors of the Content.


You agree that you are solely responsible for (and that OLED SPACE has no responsibility to you or to any third party for) any breach of your obligations under these Terms and for the consequences (including any loss or damage which LGD may suffer) of any such breach.


9. Links To Third-Party Content


OLED SPACE may include hyperlinks to other web sites that are not owned or controlled by LGD. LGD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.


You acknowledge and agree that LGD is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.


You acknowledge and agree that LGD is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.


10. Indemnity


To the maximum extent allowed by law, you agree to defend, indemnify, and hold us, our affiliates, our licensors, our third party service providers and our officers, employees, and agents (the “OLED SPACE Entities”) harmless from and against any claim, loss, damage, injury, costs (including attorneys’ fees) or demand made, suffered or incurred by any third party due to or arising out of (a) your violation of these Terms, (b) your violation of applicable laws or regulations, or (c) Your Content or Your Account. We reserve the right to control the defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.


11. Disclaimers


OLED SPACE AND ANY SERVICES RELATED THERETO ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKE ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF OLED SPACE. LGD MAKES NO WARRANTY OR REPRESENTATION THAT ANY SERVICES, INFORMATION, CONTENT, MATERIALS, OR PRODUCTS (INCLUDING SOFTWARE) INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH OLED SPACE  IS ACCURATE, SECURE, COMPLETE, RELIABLE, CURRENT, OR ERROR FREE. OLED SPACE DOES NOT CONTROL, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY CONTENT AVAILABLE ON OR LINKED TO OLED SPACE OR THE ACTIONS OF ANY THIRD PARTY OR SERVICES USER, INCLUDING MODERATORS. WHILE LGD ATTEMPTS TO MAKE YOUR ACCESS TO AND USE OF OLED SPACE SAFE, WE DO NOT REPRESENT OR WARRANT THAT OUR SERVICES OR SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL COMPONENTS.


12. Limitation of Liability


IN NO EVENT AND UNDER NO THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE, WILL THE OLED SPACE ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS ARISING FROM OR RELATING TO THESE TERMS OR OLED SPACE, INCLUDING THOSE ARISING FROM OR RELATING TO CONTENT MADE AVAILABLE ON OLED SPACE THAT IS ALLEGED TO BE INFRINGING, DEFAMATORY, OFFENSIVE, OR ILLEGAL. ACCESS TO, AND USE OF, OLED SPACE IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM. THE LIMITATIONS OF THIS SECTION WILL APPLY TO ANY THEORY OF LIABILITY, INCLUDING THOSE BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND EVEN IF THE OLED SPACE ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF ANY REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. THE FOREGOING LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.


13. Governing Law and Venue


In some jurisdictions, the laws of the Republic of Korea does not apply to some types of disputes. If you live in a country that will not apply the laws of the Republic of Korea, the laws of your country of residence may apply to any dispute relating to these Terms. Otherwise, you agree that the laws of the Republic of Korea shall apply to any disputes arising out of or in connection with these Terms without reference to conflict of laws. Likewise, if a court in your home country does not agree to the jurisdiction or venue of a court in the Republic of Korea, disputes relating to this Agreement may be subject to local jurisdiction or venue. Otherwise, any lawsuits that arise in connection with these Terms will be treated exclusively in the courts of the Republic of Korea, and you and LGD agree that such courts have jurisdiction.  


Notwithstanding the above, if you live in the European Economic Area, these Terms and your relationship with LGD with respect to OLED SPACE will be governed by the laws of your country of residence, and legal proceedings may be brought in your local courts.


If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.


14. Changes to these Terms


We may make changes to these Terms from time to time. All changes are effective immediately when we post them, and apply to all access to and use of OLED SPACE thereafter. If the changes, in our sole discretion, are material, we may also notify you by sending an email to the address associated with Your Account or by otherwise providing notice through OLED SPACE. By continuing to access or use OLED SPACE on or after the posting of the revised Terms, you agree to be bound by the revised Terms. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. Your use of OLED SPACE following any amendment of these Terms will signify your assent to and acceptance of its revised terms. If you do not agree to the revised terms, you must immediately stop accessing and using OLED SPACE.


15. Termination


You may terminate these Terms at any time and for any reason by deleting Your Account and discontinuing your use of all Content and OLED SPACE. If you stop using OLED SPACE without deactivating Your Account, these Terms will remain in effect with respect to Your Account, although Your Account may be deactivated due to prolonged inactivity.


We may suspend or terminate Your Account, status as a moderator, or ability to access or use OLED SPACE or Content at any time for any or no reason, including for a violation of these Terms.


The following sections will survive any termination of these Terms or of Your Account: 4 (Your Content), 5 (License From You), 6 (Other User’s Content), 8 (Things You Cannot Do), 9 (Links to Third-Party Content), 10 (Indemnity), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Governing Law and Venue), 15 (Termination), and 17 (Miscellaneous).


16. Waiver and Severability


No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.


If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.


17. Miscellaneous


These Terms constitute the entire agreement between you and us regarding your access to and use of OLED SPACE. You may not assign or transfer any of your rights or obligations under these Terms without our consent. We may freely assign any of our rights, or delegate any of our duties, under these Terms.

PRIVACY POLICY


This Privacy Policy explains how we process your personal data, including how we collect, use and process your personal date, and how, in doing so, we comply with our legal obligations. 


This policy also describes your data protection rights, including a right to object to some of the processing. More information about your rights, and how to exercise them, is set out in the “Your Rights” section.


This Privacy Policy applies only to the websites and services controlled by LG Display Co., Ltd. (“LGD”) where this Privacy Policy is posted or referenced and through information collected via OLED SPACE website "https://en.oledspace.com/" ("Website"). This Privacy Policy does not pertain to other information that is collected offline or to information that is posted or provided by third parties. 


A. Information We Collect


(1) Information You Provide Directly to Us


We collect your email address, user name and profile photos when you create your OLED SPACE account by linking your Facebook, Twitter or Google account; and/or


We may collect your first and last name, telephone number, delivery address and email address if you choose to participate in a contest or sweepstakes.

 

The above list provides an example of the personally identifiable information that may be collected on the Website. 


(2) Website and Usage Information


When you visit the Website there is certain information that we may automatically collect, whether or not you decide to create your OLED SPACE account. This includes your IP address, the date and the times and frequency with which you access the Website and the way you browse its content.

 

(3) Cookies and Other Similar Technologies


Cookies are small data files that are placed on the hard drive of your computer, tablet, smartphones or other device when you visit a website and other tracking tools on our website and digital platforms. Some cookies are functional and enable additional functionality when a user accesses the Website (e.g. allows users to save user preferences or language suggestions). Other cookies are non-functional and allow the website and third parties to tailor messages and advertising relevant to a user’s interests. When we refer to cookies, this includes other similar technologies such as web beacons.

Without these cookies, the services available to you on our site cannot be provided.
